Terms of Use

These Terms of Use (the “Terms”) govern the use of the website artancenter.com (the “Website”), owned by [full legal name of the company that owns the Website] (the “Company”, “we”). The Company operates under the trade names ARTAN GROUP, ARTAN TRAINING CENTER and ARTAN SECURITY COMPANY (together, “ARTAN”). These are brand names; they are not, in themselves, a party to any contract.

By using the Website you confirm that you have read and accept these Terms. If you do not agree with any of their provisions, please stop using the Website.

These Terms supplement, but do not replace, the Privacy Policy, the Cookie Policy and the Public Offer. Where the terms of a specific service are concerned, the Public Offer or an individual written contract with the client prevails.

1. General provisions

The Website provides information about ARTAN training programmes and security services, allows visitors to submit enquiries and complaints, and presents the Company’s activities in general. We reserve the right to change the structure, content and functionality of the Website without prior notice.

Use of the Website is free of charge. These Terms do not create any employment, agency or partnership relationship between you and the Company.

2. Website owner details

The following details are disclosed pursuant to Article 7 of the Law of Ukraine “On Electronic Commerce” No. 675-VIII of 3 September 2015 and are permanently accessible from any page of the Website:

Licence for security activities issued by the Ministry of Internal Affairs of Ukraine: [series, number, date of issue and validity period of the licence issued by the Ministry of Internal Affairs of Ukraine]. The validity of the licence can be verified independently in the State Licensing Register of the Ministry of Internal Affairs of Ukraine — mylicense.mvs.gov.ua.

The ARTAN group comprises several business entities, therefore the holder of the security licence and the contracting party for a particular service may be different legal entities: [which group entity is the contracting party for each type of service (training / security) and which entity holds the licence].

3. Language of the Website

The Website is available in Ukrainian and English. The Ukrainian version loads by default for users located in Ukraine and is no smaller in volume and content than the English version, as required by Article 27 of the Law of Ukraine “On Ensuring the Functioning of the Ukrainian Language as the State Language” No. 2704-VIII of 25 April 2019.

The English version of these Terms and of the other legal documents on the Website is a translation provided for the convenience of international users. In the event of any discrepancy between the Ukrainian and the English text, the Ukrainian version prevails.

4. Intellectual property

All content of the Website — texts, photographs, video, graphics, design, structure and source code — is the intellectual property of [full legal name of the rights holder] or is used on lawful grounds (licence or permission of the rights holder).

The designations ARTAN GROUP, ARTAN TRAINING CENTER, ARTAN SECURITY COMPANY, the logos and the corporate identity belong to the Company: [trade mark registration details (certificate numbers), if the marks are registered]. Use of these designations by third parties without the Company’s written permission — in particular in advertising, domain names, account names, or in any way that may create a misleading impression of affiliation with ARTAN — is prohibited.

Please note in particular that training and methodological materials (curricula, manuals, presentations, handouts, recordings of classes) are provided to course participants strictly for personal, non-commercial use. Copying, distribution, publication, translation, transfer to third parties or use for delivering one’s own training is prohibited.

Copying, reproduction, distribution or other use of Website materials without the Company’s prior written consent is prohibited, except for free use expressly permitted by Ukrainian copyright law (in particular, quotation in a justified volume with mandatory attribution of the source and an active link to the Website).

Logos, trade marks and other designations of partners, clients and third parties that may appear on the Website belong to their respective owners and are used solely for identification purposes.

5. Rules of use

It is prohibited to:

• use the Website in any manner that breaches the legislation of Ukraine;
• attempt to gain unauthorised access to the servers, databases, administration panel or other infrastructure of the Website, or to circumvent technical protection measures, including request rate limits;
• distribute through the Website any malware or spam, or send automated requests (bots) that impair the operation of the Website;
• use automated tools for mass extraction of data from the Website (parsing, scraping), including for the compilation of datasets and the training of artificial intelligence systems, without our written permission;
• impersonate the Company, its employees or authorised representatives, or republish Website materials in a way that is misleading as to their source;
• take any action aimed at compromising the safety of ARTAN clients or personnel, in particular collecting information about protected sites, routes or staff.

6. Enquiries and contact forms

By submitting an enquiry through a form on the Website you confirm that the information provided is accurate and that you are authorised to provide the personal data of any other individuals mentioned. The Company is not liable for consequences caused by inaccurate or incomplete information.

Consent to the processing of personal data, acceptance of the Public Offer and consent to the use of cookies are three separate legal grounds and are given separately — these Terms are not, in themselves, any of those consents.

Please do not submit through the Website forms any special categories of data — information about health or medical contraindications, biometric or genetic data, information about criminal convictions — nor any confidential or proprietary information of third parties. Such data are not collected via the Website; where necessary, they are handled outside the Website, in a secured environment and on the basis of separate written consent.

Age requirements for course participants are determined by the programme of each particular course: [minimum age of participants per training programme — to be confirmed by the client].

7. Nature of the information published on the Website

• information about services, prices, programme content and duration is informational in nature and is confirmed when an enquiry is processed;
• security services are provided solely on the basis of a written contract setting out the list of services and the terms of compensation for damages (Article 8 of the Law of Ukraine “On Security Activities” No. 4616-VI of 22 March 2012). Nothing on the Website constitutes an offer to conclude a security services contract, nor does it replace such a contract;
• enrolment in training programmes is governed by the Public Offer;
• Website materials (articles, news, course descriptions) do not constitute professional legal, medical or security advice and cannot replace an individual assessment by a qualified specialist;
• upon completion of a course, a certificate of the training centre is issued confirming attendance of the programme; it is not a formal education document and does not confer an educational or professional qualification, unless expressly stated otherwise in the description of a specific programme;
• the Company delivers its services in accordance with the agreed scope of work and professional standards, but does not guarantee any specific outcome — no wording on the Website may be construed as a guarantee of safety or a guarantee of the result of a check or investigation.

8. Links to third-party resources

The Website may contain links to third-party resources (social networks, partners, news sources, state registers). We do not control the content of such resources and are not responsible for their content, availability, privacy policies or data handling practices. You follow such links at your own risk.

9. Limitation of liability

The Website and its content are provided “as is”. We make reasonable efforts to keep the information accurate and the Website operational, but we do not warrant the absence of technical failures, errors or temporary unavailability of the Website.

We are not liable for indirect, incidental or consequential damages arising out of the use of, or the inability to use, the Website.

These limitations apply only to the extent permitted by the legislation of Ukraine and do not limit the rights of consumers — individuals ordering services for personal needs — under the Law of Ukraine “On Protection of Consumer Rights” No. 1023-XII of 12 May 1991, nor any liability that may not be limited by contract under the law.

10. Personal data and cookies

Personal data of Website visitors are processed in accordance with the Privacy Policy, and cookies are used in accordance with the Cookie Policy. Supervision in the field of personal data protection in Ukraine is exercised by the Ukrainian Parliament Commissioner for Human Rights (Ombudsperson), which acts as the national data protection supervisory authority.

In respect of individuals who are located in the European Union at the time they contact us, Regulation (EU) 2016/679 (GDPR) additionally applies — the scope of their rights and the procedure for exercising them are described in the Privacy Policy.

11. Complaints and enquiries

Matters concerning the quality of services, the conduct of personnel or any other violation are handled in accordance with the Complaints Mechanism, which also sets out the claims-handling procedure and the applicable time limits.

12. Governing law and dispute resolution

These Terms are governed by and construed in accordance with the legislation of Ukraine. Any disputes arising in connection with the use of the Website shall be resolved through negotiation and, failing agreement, in court in accordance with the jurisdiction rules established by Ukrainian procedural law. A consumer who is an individual retains the right to choose the competent court in the cases provided for by procedural law.

For corporate clients (legal entities, international organisations, diplomatic missions), the governing law, the dispute resolution procedure and the language of the contract may be determined by a separate written agreement; to the extent covered by such an agreement, it prevails over these Terms.

13. Amendments to the Terms

We may update these Terms unilaterally. Each version is dated; the version published on this page is the one in force. Continued use of the Website after changes are published constitutes acceptance of the updated version.

Amendments to these Terms have no retroactive effect on contracts already concluded: such contracts remain governed by the version of the Public Offer in force at the moment of its acceptance. Previous versions are available on request at training@artan.center.
